Federal Judge Orders Freedom of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The situation originates in a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an error. After his repatriation to the United States to answer alien smuggling charges, he was detained in immigration detention.
In her order, the judge noted that the government lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
Context of the Case
The court challenge center on disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently disputes this claim.
He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing criminal case in Tennessee.
Conditions of Release
The court, who was overseeing his challenge to deportation in a Maryland district court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.
This decision represents a significant turn in a complex legal case featuring allegations of wrongful detention and contested gang affiliations.
